Refund & Cancellation Policy
How refunds, cancellations, managed-service commitments, and project payments are handled.

1. Custom website setup and project payments
Website projects involve custom design, development, setup, configuration, and reserved production time. Unless a signed proposal states otherwise, an initial project payment becomes non-refundable once substantive project work begins. Payments tied to completed milestones, completed work, launch readiness, or delivered work are non-refundable except where required by law or where Open Choice Digital agrees otherwise in writing.
2. Cancellations before work begins
If a client cancels before substantive project work begins, Open Choice Digital may refund some or all of the project payment after deducting any non-recoverable third-party costs, transaction fees where permitted, or work already completed. Any different cancellation terms stated in the signed proposal control.
3. Managed website services
Unless the signed proposal states otherwise, new managed website engagements include an initial six-month commitment after launch. The commitment reflects the time and responsibility involved in setup, deployment, technical configuration, monitoring, maintenance, and continued operation of the managed environment.
4. Ending managed service during the initial term
A request to stop managed service before the initial six-month commitment ends does not automatically cancel the remaining commitment. The client may satisfy the remaining balance, agree to a written early-termination or buyout arrangement, or follow any project-specific termination terms in the signed proposal. Source-code transfer and migration assistance are not automatically included during an unresolved early termination.
5. Ending managed service after the initial term
After the initial commitment is complete, managed service continues month to month unless the proposal states otherwise. Either party may end managed service with 30 days' written notice. Monthly fees already charged for a current service period are generally non-refundable because hosting, monitoring, support availability, and other managed responsibilities are provided throughout that period.
6. Third-party and non-recoverable costs
Domain registrations, software licenses, premium integrations, API usage, payment processing charges, advertising spend, and other third-party costs may be non-refundable once purchased, incurred, or committed. When a third-party provider offers a refund, Open Choice Digital will handle any client credit according to the applicable proposal and the provider's actual refund.
7. Project delays or inactivity
Client delays, missing materials, missing approvals, or lack of access do not automatically create a refund right for work already completed or time already reserved. Open Choice Digital may pause or reschedule inactive projects and may quote additional work if a long delay materially changes the project.
8. Billing concerns, disputes, and chargebacks
If you believe a charge is incorrect or the service delivered does not match the signed proposal, contact Open Choice Digital promptly so the issue can be reviewed. We encourage clients to give us a reasonable opportunity to resolve billing or service concerns before starting a payment dispute. This does not limit any rights available under applicable law.
9. Exceptions
Open Choice Digital may approve a full or partial refund, credit, revised payment schedule, or other resolution when circumstances justify it. Any exception must be confirmed in writing and does not change the policy for other projects.
10. Relationship to proposals and service terms
A signed proposal may include project-specific payment, refund, cancellation, or termination terms. If those terms conflict with this policy, the signed proposal controls. This policy should be read together with the Standard Service Terms.
